Loyalty Terms & Conditions

1. INTRODUCTION

1.1. Scanlan Theodore Loyalty is the loyalty program offered by Scanlan & Theodore Pty. Ltd. ABN 64 006 782 609 (“Scanlan Theodore”, “we” or “us”). These Terms govern your participation in Scanlan Theodore Loyalty. They apply in addition to Scanlan Theodore’s standard Terms & Conditions and Privacy Policy, which are available on our website at www.scanlantheodore.com/au. By joining or participating in Scanlan Theodore Loyalty, you agree to be bound by these Terms, our standard Terms & Conditions, and the Privacy Policy (together, the “Agreement”).

2. ACCEPTING THESE TERMS AND CONDITIONS

2.1. Please read these Terms as well as our standard Terms & Conditions and our Privacy Policy, which are available via the internet (collectively, the “Agreement”) carefully before joining or participating in Scanlan Theodore Loyalty. By joining Scanlan Theodore Loyalty, creating an account, opting in, or otherwise participating in Scanlan Theodore Loyalty, you (“Member” or “you”) agree to all the Terms & Conditions of this Agreement. If you do not agree to all the Terms & Conditions of this Agreement, you may not participate in Scanlan Theodore Loyalty.

3. MODIFICATIONS TO THE AGREEMENT

3.1. Scanlan Theodore may, in its sole discretion, modify these Terms at any time by posting a revised version on its website or otherwise notifying Members. Modifications are effective when posted or notified, and your continued participation in Scanlan Theodore Loyalty following such posting or notification constitutes your acceptance of the Terms as modified. Any modifications made after you have accrued a reward, credit, voucher, benefit or entitlement (hereinafter “Reward”) will not affect that Reward during its stated validity period, unless the modification is required by law. Changes will apply only to Rewards or eligibility criteria accrued after the date the modification takes effect.

4. PRIVACY

4.1. Any information you provide to Scanlan Theodore in connection with Scanlan Theodore Loyalty is subject to Scanlan Theodore’s Privacy Policy, which governs our collection and use of your information. By joining or participating in Scanlan Theodore Loyalty, you consent to the collection and use of your information for the purposes of administering Scanlan Theodore Loyalty, providing you with personalised Rewards and offers, and as otherwise set forth in the Privacy Policy.

5. ELIGIBILITY AND MEMBERSHIP

5.1. Participation in Scanlan Theodore Loyalty is open only to individuals who are at least 18 years of age. By applying to join or by participating in Scanlan Theodore Loyalty, you represent and warrant that you meet this eligibility requirement.
5.2. To become a member of Scanlan Theodore Loyalty, you must create an account with Scanlan Theodore and actively opt in to Scanlan Theodore Loyalty. Opt-in requires a positive action by you (for example, ticking an unticked box when signing up online or confirming via a customer service representative in-store).
5.3. Membership in Scanlan Theodore Loyalty is free of charge, is limited to one account per individual, and is strictly for personal use only. Memberships are non-transferable and may not be assigned, sold or otherwise dealt with.
5.4. You may opt out of Scanlan Theodore Loyalty at any time by adjusting your account settings or by contacting Scanlan Theodore. Opting out will stop your participation in Scanlan Theodore Loyalty and you will no longer receive loyalty program Rewards or communications. Your customer account with Scanlan Theodore will remain active for purchases unless you separately request closure of that account

6. NATURE OF THE PROGRAM

6.1. Scanlan TheodoreLoyalty is a discretionary loyalty program operated by Scanlan Theodore.
6.2. Rewards offered under Scanlan Theodore Loyalty are gestures of appreciation and may vary between Members. Participation in Scanlan Theodore Loyalty does not guarantee that you will receive any particular Reward or offer, nor will you have visibility regarding Rewards or offers received by others. .
6.3. Scanlan Theodore may consider Member activity and engagement with the brand when deciding whether to extend Rewards. These assessments are made internally and at Scanlan Theodore’s discretion, and do not create any entitlement or right on the part of Members.
6.4. Scanlan Theodore may, in its discretion, vary or withdraw any Reward or offer from time to time. Any such variation or withdrawal will apply prospectively and will not affect any Reward that has already been issued or accrued and remains valid, unless the variation or withdrawal is required by law.

7. REWARDS

7.1. Rewards offered under Scanlan Theodore Loyalty may include, without limitation, welcome gifts, styling invitations, complimentary shipping, early access to new collections, seasonal previews, promotional codes, or other gestures of appreciation.
7.2. Rewards are provided at Scanlan Theodore’s discretion, may vary between Members, and are not guaranteed. The availability, nature and timing of Rewards may differ depending on Member engagement and other factors determined by Scanlan Theodore.
7.3. Rewards are for personal use only, are non-transferable, and cannot be redeemed for cash or credit unless expressly stated otherwise.
7.4. Rewards may be subject to an expiry date, which will be disclosed at the time of issue and made visible in your account. Rewards that have expired are forfeited and cannot be reissued. Scanlan Theodore will provide Members with 30 days’ notice prior to expiry.
7.5. Rewards may be subject to additional terms or conditions specified at the time they are issued. In the event of any inconsistency, those specific terms will apply in relation to the relevant Reward.

8. USE OF REWARDS

8.1. Rewards must be redeemed in accordance with the instructions provided by Scanlan Theodore at the time of issue.
8.2. Rewards may only be used by the Member to whom they are issued and may not be sold, assigned, transferred, or exchanged for value, unless expressly permitted by Scanlan Theodore.
8.3. Rewards may only be redeemed once and will not be reissued if lost, stolen, misplaced, expired, or used without authorisation.
8.4. Rewards are not gift cards or vouchers for the purposes of the Australian Consumer Law or any applicable gift card legislation, unless expressly stated otherwise.

9.RETURNS, REFUNDS AND EXCHANGES

9.1. Returns, refunds and exchanges are governed by Scanlan Theodore’s standard Terms & Conditions and by the Australian Consumer Law.
9.2. Where a purchase was made using both a Reward and another form of payment, any refund (if payable) will be processed using the same method of payment used for the original purchase. This means the cash or card portion will be refunded to your original payment method, and the Reward portion will be reinstated or otherwise accounted for in accordance with these Terms & Conditions and applicable law.
9.3. Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that you may have under the Australian Consumer Law. If a product or service fails to meet a consumer guarantee under the Australian Consumer Law, you may be entitled to a repair, replacement or refund.

10. MEMBERSHIP DURATION AND REVIEW

10.1. Membership in Scanlan Theodore Loyalty continues until terminated by you or by Scanlan Theodore in accordance with these Terms & Conditions.
10.2. Scanlan Theodore reviews Member engagement annually to assess ongoing eligibility for Rewards. To maintain eligibility for ongoing Rewards, Members must make at least one purchase in each 12-month period.
10.3. If this requirement is not met, the Member’s membership may lapse and any unredeemed Rewards may be cancelled. Scanlan Theodore will provide Members with notice prior to any lapse of membership or withdrawal of Rewards.
10.4. Members may opt out of Scanlan Theodore Loyalty at any time by updating their account preferences or by contacting Scanlan Theodore.

11. CHANGES, SUSPENSION AND TERMINATION

11.1. Scanlan Theodore may amend, suspend or terminate Scanlan Theodore Loyalty at any time, subject to these Terms & Conditions and applicable law. Any modifications made after a Member has accrued a Reward will not affect that Reward during its stated validity period, unless the modification is required by law. Changes will apply only to Rewards accrued after the date the modification takes effect.
11.2. This protection does not apply where a Member’s participation is suspended or terminated due to breach of these Terms, breach of Scanlan Theodore’s standard Terms & Conditions, provision of false or misleading information, misuse, fraud, abuse, or other conduct detrimental to Scanlan Theodore Loyalty, Scanlan Theodore or other Members. In those circumstances, Scanlan Theodore may cancel accrued Rewards as well as the Member’s membership in Scanlan Theodore Loyalty without prior notice.
11.3. Members may terminate their participation in Scanlan Theodore Loyalty at any time by adjusting their account settings or contacting Scanlan Theodore.

12. PROMOTIONS

12.1. From time to time, Rewards offered under Scanlan Theodore Loyalty may include promotional codes. Any promotional codes may be subject to additional terms and conditions specified at the time of issue. Unless otherwise stated, promotional codes cannot be transferred, redeemed for cash, or used in conjunction with other offers.

13. LIABILITY

13.1. Nothing in these Terms excludes, restricts or modifies any rights, remedies or guarantees that you may have under the Australian Consumer Law or any other applicable law which cannot lawfully be excluded or limited.
13.2. To the fullest extent permitted by law, Scanlan Theodore is not liable for any loss or damage arising in connection with Scanlan Theodore Loyalty, including the granting, use, withdrawal or expiry of any Reward, except to the extent that such loss or damage is caused by Scanlan Theodore’s negligence, fraud, or wilful misconduct, or is otherwise required by law.

14. APPLICABLE LAW AND JURISDICTION

14.1. These Terms & Conditions are governed by the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria in relation to any legal proceeding directly or indirectly arising out of or relating to these Terms or Scanlan Theodore Loyalty.
